No Immunity & Mandatory-Law Supremacy

No private document creates immunity. Terms, notices, architectural boundaries and technical controls can improve notice, consent, rights allocation, evidence and risk management. They cannot bind regulators or non-signatories, waive mandatory law, change the legal effect of actual conduct, cure unlawful activity or prevent every investigation, claim or remedy.

Supremacy rules

  1. Actual conduct prevails. Functions, users, data, decisions, control, communications, counterparties, locations and money flows determine treatment.
  2. Mandatory law prevails. Non-waivable statutes, regulations, public-policy rules, regulator powers, court orders and individual rights remain effective.
  3. Substance prevails over form. Labels such as “research,” “simulation,” “reference,” “sovereign,” “agent” or “decision support” do not alter the substance of a deployment.
  4. Qualified review prevails over automation. Machine-generated legal or fiscal classifications are candidate analyses only.
  5. Local rules prevail where applicable. A universal package must be localized for operator, audience, data, sector and jurisdiction.

Lawful minimization doctrine

Regulatory surface may be reduced only through genuine product scope, data minimization, bounded authority, truthful communications, lawful entity substance, explicit exclusions, reversible design and separation between analysis and execution. The following are prohibited: sham residence, hidden beneficial ownership, sanctions diversion, false filings, fabricated evidence, misleading claims, unauthorized practice, disguised regulated services, consumer or worker deception and artificial arrangements lacking business purpose.

Escalation rule

When a contemplated feature may create licensing, registration, fiduciary, custody, financial, employment, health, biometric, public-sector, export-control, sanctions, critical-infrastructure or high-impact-decision obligations, keep execution disabled until current official sources, verified facts, qualified advice, authorization and evidence receipts are complete.
